General Terms and Conditions (GTC) of Intrapass GmbH
1. Scope
1.1 These GTC apply to the transportation of parcels, goods, bulky items, and lost property by Intrapass GmbH or its subcontractors, including additional services such as collection, packaging, delivery, or customs clearance of the shipment.
1.2 These GTC specifically apply to the shipping of lost property from Zurich Airport to worldwide destinations.
1.3 Unless otherwise stipulated in these GTC, the provisions and conditions of Spedlogswiss (www.spedlogswiss.ch) apply, as well as, for cross-border transport, the CMR (Convention on the Contract for the International Carriage of Goods by Road) and the Montreal Convention (international air transport).
2. Validity of Offers
Offers become void if they are not accepted within 10 days of issuance.
3. Order Placement
3.1 Orders must be placed in writing or via electronic means. In the case of verbal or telephone orders, the client assumes the risk of transmission errors.
3.2 Orders must include all necessary information, particularly regarding regulated goods or special transport requirements.
4. Verification
Intrapass GmbH carefully reviews the orders received but is not obligated to inspect the contents of transport containers or shipments or to conduct weight or dimension checks. If any uncertainties arise, Intrapass GmbH will clarify them with the client.
5. Exclusion of Liability
5.1 Intrapass acts as an intermediary between the sender and the transport service provider. Therefore, Intrapass assumes no liability for delays, damages, or losses incurred during transport or customs clearance.
5.2 Any damages or losses must be reported within 5 days of receipt or the expected delivery date. Claims not submitted within this period are forfeited.
5.3 Intrapass is not liable for indirect or consequential damages, including lost profits or business interruptions.
6. Liability Limitation for Lost Property Shipping
6.1 Intrapass’ liability for lost or damaged lost property shipments is limited to:
- Documents: up to CHF 150.00
- Goods: up to CHF 300.00 per shipment
6.2 If additional insurance has been taken out, the liability limit increases to CHF 1,500.00.
6.3 For international shipments, the statutory liability limitations apply:
- 22 SDR per kg for air transport
- 8.33 SDR per kg for road transport
7. Transport Insurance
7.1 Transport insurance is only taken out at the express request of the client.
7.2 Intrapass assumes no liability for the adequacy of the insurance coverage.
8. Unforeseen Storage
If the recipient refuses acceptance of the goods or if transport is delayed, the goods will be stored at the client’s expense and risk. Intrapass will notify the client and, if applicable, the transport insurer.
9. Additional Charges and Refunds
Intrapass is not responsible for incorrect freight, customs, or duty charges that it has not caused.
10. Client’s Liability
The client is liable for incorrect information, inadequate packaging, or missing documents that cause damages or delays.
11. Liability of Intrapass GmbH
11.1 Intrapass is liable for the careful execution of orders but not for force majeure or damages caused by third parties.
11.2 If subcontractors are engaged, Intrapass is only liable for their careful selection.

12. Payment Terms
12.1 Invoices must be paid within 10 days of issuance. Late payments may incur additional fees.
12.2 Intrapass may require advance payments or security deposits.
13. Payment Default
13.1 The contractually agreed or invoiced payment deadlines are due dates. If the deadline expires, the client is in default. The default interest rate is 5%.
13.2 Intrapass GmbH may send payment reminders and dunning letters to the client. The following fees apply:
a. Payment reminder: free of charge
b. First dunning letter: CHF 20
c. Second dunning letter: CHF 40
14. Right of Retention
14.1 Intrapass GmbH has a lien on transported goods for outstanding claims against the client.
14.2 If the payment deadline expires without success, Intrapass may liquidate the relevant goods.
15. Jurisdiction and Applicable Law
These GTC are subject to Swiss law. The place of debt enforcement for clients residing abroad (pursuant to Art. 50 para. 2 SchKG) and the exclusive place of jurisdiction for all disputes arising from or in connection with this contract or parts thereof, as well as for all proceedings, is at the registered office of Intrapass GmbH. However, Intrapass GmbH reserves the right to bring such proceedings before the competent courts at the client’s place of residence or any other competent court, with Swiss substantive law remaining exclusively applicable.
16. Final Provisions
16.1 These GTC may be amended at any time without prior notice. The current version is available at www.intrapass.ch/agb.
16.2 If any provision of these GTC is invalid, the remaining provisions shall remain valid.
